1- L’Utente dà atto di essere a conoscenza che il foglio di calcolo è stato studiato e sviluppato da ASDEA S.r.l., con sede legale in Pescara, Via Tirino n. 14, P.IVA 01888500681, che ne detiene la licenza d’uso esclusiva ed illimitata con facoltà di concederla al singolo utente.
2- La presente licenza d’uso è concessa a titolo gratuito e non è in alcun modo trasferibile o cedibile a terzi. E’ fatto, altresì, espresso divieto di concedere il prodotto in uso, in locazione, in leasing o in comodato o di distribuirlo in qualunque forma o modo, sia a titolo gratuito che a titolo oneroso, nonché di fornire hosting di servizi commerciali a terzi utilizzando il prodotto.
3- L’Utente si impegna a controllare periodicamente l’esistenza di eventuali aggiornamenti del software. Eventuali aggiornamenti saranno disponibili nella versione on line del foglio di calcolo.
4- Il presente contratto non trasferisce all’utente il codice sorgente del software licenziato né la relativa documentazione logica e/o di progetto. E’ vietato decodificare, decompilare o disassemblare il prodotto.
5- ASDEA non fornisce alcuna assistenza tecnica per l’utilizzo del foglio, cui dovrà provvedere direttamente l’Utente.
6- Il presente foglio di calcolo è uno strumento destinato ad essere utilizzati soltanto da professionisti esperti, non può in alcun caso sostituire le conoscenze professionali dell'Utente ed è utilizzabile quale strumento di assistenza nel progetto. L’Utente è l’unico responsabile della scelta del foglio di calcolo e della rispondenza del medesimo alle proprie esigenze e finalità di utilizzazione.
7- ASDEA non si assume alcuna responsabilità sull’utilizzo del software da parte dell’Utente. Rimane a carico dell’Utente ogni e qualsiasi responsabilità per danni diretti e/o indiretti comunque subiti dall’Utente medesimo e/o da terzi in conseguenza dell’uso del foglio di calcolo licenziato.
In nessun caso la ASDEA risponderà dei danni a qualunque titolo connessi e/o conseguenti ad eventuali vizi di qualità, di adeguatezza e di utilizzabilità delle opere progettate con il foglio oggetto di licenza, che restano pertanto ad esclusivo carico dell’Utente.
Responsabile dell’intera progettazione strutturale rimane sempre e comunque il Progettista incaricato (D.M. 14/01/2008 n. 29581).
8- Il software è fornito nello "stato in cui si trova" e l'Utente riconosce che possa presentare difetti. ASDEA esclude ogni obbligo di garanzia e qualsivoglia responsabilità nei confronti dell'utente. ASDEA non può prestare e non presta alcuna garanzia relativa alle prestazioni o ai risultati che l'Utente potrà ottenere tramite l'utilizzo del software o della relativa documentazione. Con il download o l’utilizzo del foglio di calcolo, l’Utente dichiara di aver preso piena conoscenza delle condizioni del contratto di licenza del foglio in oggetto, di accettarle integralmente e di approvare specificamente, ai sensi degli artt. 1341 e 1342 c.c., le seguenti clausole: 1,2,3,4,5,6,7,8.
